Senate Minority Leader Franklin Drilon reasoned that if former Senator Jinggoy Estrada can take a day-off from Sandiganbayan to attend a birthday party, so should detained Senator Leila de Lima be allowed to take seat in the Senate during important sessions.

This was how Drilon contrasted the two situations as he and his fellow senators approached the Muntinlupa Regional Trial Court Branch 204 to appeal for De Lima’s occasional appearance at the Senate.

“If former Sen. Jinggoy Estrada was given furlough to attend the 80th birthday of [former] President Estrada and also [former senator] Bong Revilla who was allowed to visit his father, then the same reasoning should allow Senator De Lima to perform her task as a senator,” Drilon said.

Even when De Lima is imprisoned, Drilon appeals to the former’s senator status as a reason to let De Lima continue with her senatorial duties.

“She’s only physically restrained from attending the Senate hearings or sessions because she’s under detention. She’s under the custody of the court and therefore the court can authorize her to attend Senate sessions and cast her vote,” he said.

However, Drilon assured that this furlough will only be applicable during important sessions.

“Well not in all cases where she we’ll petition the court to allow her to attend but in certain critical votes in the Senate, for example the death penalty or possibly the postponement of the barangay elections. When there is a need, we will ask the court to allow her to cast her vote,” the Senate leader added.
